JEWISH MARRIAGE COUNCIL MEDIATION SERVICE


WHAT IS MEDIATION?

Mediation allows couples to discuss and resolve arrangements concerning their finances, arrangements for the children as well as issues with the Get at the end of a relationship.

Mediation provides a more cost effective, amicable and quicker resolution than the more traditional solicitor/court process.


MIAMS (Mediation Information and Assessment Meetings)
Since April 2014, any person wishing to make a Court application regarding the resolution of the family finances, or to make an application with respect to any arrangements for children, is required to attend a MIAM.  The purpose of this meeting is to assess whether mediation would be appropriate in the given situation and gauge the willingness of both parties to attend mediation.  If, for any reason the mediation does not take place, the mediator can sign the relevant Court papers to allow the Court application to be made.


HOW MUCH DOES MEDIATION COST?
The Jewish Marriage Council charges £75 for a MIAM and £200 for a mediation session. There is an additional cost of £150 for drawing up the "Memorandum of Understanding", which details in full the final agreement reached at the end of mediation.  This service is provided at a significantly reduced fee and aims to help those who are not eligible for legal aid, but are unable to fund the full cost of mediation.  To meet the criteria we ask that:

1.  Neither party is earning over £40,000 gross per annum; or

2.  The parties' combined annual income is less that £65,000 gross per annum; and

3.  The total net assets are less than £300,000.


WHO IS THE MEDIATOR AT THE JMC?
The service is run by Rachel Jaysan (Dor-Chay).  Rachel is a family solicitor and mediator specialising in all aspects of family law. Rachel is also experienced in religious divorce, particularly in the complexities of the Jewish Get.  She runs her own mediation practice and is a consultant solicitor with OGR Stock Denton LLP.
